Terms & Conditions
Payment terms are fifteen (15) days from date of invoice. Delinquent payments after thirty (30) days will be charged an interest rate of 1.5% per month.
UPDS applies a fuel surcharge to its programs as the result of unexpected fluctuations in diesel fuel prices tied to world events and subsequent market speculation.
Unless otherwise specified in a customized rate document, fuel surcharges applied to UPDS rates are based on the Department of Energy's (DOE) On-Highway Diesel Fuel Price (US Average).
UPDS Carload Solutions Transload fuel surcharge follows Union Pacific's methodology and calculations. See the railroad's Carload Mileage Based Standard HDF Fuel Surcharge and Carload Revenue Based Standard HDF Fuel Surcharge for more information.
UPDS is positioned to help customers transition to a mileage based fuel surcharge. Contact us for details.
All services, terms, conditions, policies, rates and charges will be communicated in one of two ways:
- Market-based programs shall be posted on this Web site. It is the responsibility of customers utilizing these programs to visit the site on a regular basis to ensure that they have the most current information. Rates and fuel surcharges can change at any time. UPDS endeavors to post changes no less than ten (10) days prior to a price change.
- Customers who ship goods under customized UPDS programs will receive written documentation from UPDS as to services provided, terms, conditions, policies, rates, and charges. Rate quotes, whether written or verbal, do not constitute authorized documentation for shipment. In the event of a conflict in terms and conditions between a customized rate document issued by UPDS and a similar market-based program issued by UPDS, the customized document shall govern.
- Circulars and tariffs issued by Rail Carriers used by UPDS shall govern shipments while customers' goods are in the Rail Carrier's possession. This includes, but is not limited to demurrage, detention, diversions, storage, re-consignments, stop-offs, mis-routes, mis-bills, etc. UPDS will invoice customers for any charges issued by these carriers resulting from application of these rules to customer's shipments and which are beyond UPDS' control. See our (
) document for specific responsibilities for Produce shipments.
